Tbilisi Appellate Court Will Start Examination of the Shatili minibus accident case

Tomorrow, on March 15, the Tbilisi Appellate Court will start examination of the car accident case by tourist minibus in Shatili. HRC believes that the Tbilisi Appellate Court shall satisfy the appeal of the Mtskheta district prosecutor’s office and find the head of the tourist company Treveler.ge Sh.B. guilty in the initial charge imposed on him. 

As a result of the HRC’s legal advocacy, the Mtskheta district prosecutor’s office granted victim status to the family members of the passengers of the minibus, who died as a result of the accident as well as to the three passengers, who survived in the accident. 

On February 23, 2021 Mtskheta district court imposed charge and arrested the director of the tourist company and the driver of the minibus. The Mtskheta district court sent the defendants to pre-trial detention. 

In June 2021, the Mtskheta district court started hearing of the case on the merits; the victims’ assignees, survived victims, experts and other important witnesses were questioned at the hearing. 

On November 15, 2021, Judge Rezo Nadoy at the Mtskheta district court passed verdict on the car-accident of August 23, 2020 on Shatili road. G.G. was found guilty for the imposed charge under the Article 276 of the Criminal Code of Georgia (violation of transport movement safety or exploitation) and sent him to prison for 7 years. The qualification of charge against Sh.B was changed into Article 220-1 of the Criminal Code of Georgia (negligence) and was sent to prison for 3 years.

The Mtskheta district prosecutor’s office appealed the decision of the Mtskheta district court in the Tbilisi Appellate Court in relation with the head of the tourist company Traveler Ge – Sh.B. HRC believes that the Appeal Court shall find the director of the tourist company guilty under the Article 276 of the Criminal Code of Georgia, as it was the initial charge imposed on him and refers to the violation of transport movement safety or exploitation.
